Dumpster Permits in Fayetteville and Cumberland County

Two questions decide whether a container can go where you want it: does the city, town or state allow it in that spot, and is the company supplying it permitted to haul there? Here is what each official source says, as read in October 2026.

Dumpster Permits in Fayetteville and Cumberland County

The short version

Driveway or private lot: we found no city, town or county permit for a roll-off on private property anywhere we serve. Fayetteville street or sidewalk: a City Temporary Right-of-Way Encroachment permit from Public Services, valid 30 days; the FY2025–26 fee schedule listed $75 per 30 days for construction dumpsters — check the current fee. State roads: most roads outside town street systems are maintained by NCDOT, and G.S. 136-93 requires a written NCDOT permit for any obstruction placed on them. The towns: Raeford bans street obstructions outright, Hope Mills and Spring Lake keep streets and sidewalks clear, and the smaller towns publish no dumpster rule we could find. Who may haul: Fayetteville requires the "necessary approvals, permits and licenses," Cumberland County requires a health department collector's permit to use its landfill, and Robeson, Moore and Harnett counties license or permit haulers too. We hold ours.

Fayetteville — the City street permit

Driveway: no City permit was found for a roll-off on private property. Street or sidewalk: the City's Engineering Division, part of Public Services, says "If you anticipate closing and/or placing equipment in the City of Fayetteville Right of Way, please fill out the Encroachment Agreement." The form is the Temporary Encroachment Permit, filed on paper or through the City's IDT portal; commercial driveway and encroachment questions go to Traffic Services at 910-433-1660. The FY2025–26 fee schedule listed a "30 day permit for items (construction dumpsters, etc.)" at $75 per 30 days. The FY2023–24 schedule listed it at $50, and we found no FY2026–27 schedule, so check the current fee when you apply.

The form's own terms: the permit is valid for thirty days from issue, and if the encroachment runs longer you apply for a new permit and pay again. The applicant is responsible for the safety of motorists and pedestrians and for any traffic control items needed. "A minimum of a 4' cleared accessible pathway for pedestrians shall be provided. If a pathway cannot be provided, 'SIDEWALK CLOSED' signs and appropriate safety measures shall be installed." During special events all equipment comes out of the right-of-way. You notify the City Construction Management Division at (910) 433-1798 when the work starts and when it finishes, and the applicant pays for any damage to pavement, curb, gutter or sidewalk.

Fayetteville — lights, sidewalks and loading hours

City Code Chapter 24 backs the permit up. Sec. 24-6 makes it unlawful to leave building material or other obstructions on a street or sidewalk at night "without having such obstruction protected by lights." Sec. 24-7 allows building material in the street only "by permission of the city engineer, in writing." Sec. 24-18 makes blocking a sidewalk or public passageway a Class 3 misdemeanor with a fine of up to $50 — it does not apply to anyone holding a City permit, and it covers only streets not controlled by the NC Board of Transportation. Sec. 24-1 says anyone who obstructs or occupies the right-of-way reimburses the City's costs. We found no specific City rule on reflectors or cones.

Noise rules apply on the driveway too. City Code Sec. 17-11 prohibits loading, unloading or handling containers, building materials or similar objects between 7 p.m. and 6 a.m. on weekdays and 7 p.m. and 8 a.m. on weekends and holidays, in or within 50 yards of a residential area. Refuse collection vehicles may not collect in a residential area between 7 p.m. and 6 a.m. on weekdays or 7 p.m. and 10 a.m. on weekends and holidays. We schedule delivery and pickup inside those hours.

State roads — NCDOT

Outside the city's own streets, the road in front of the house is usually a state road. G.S. 136-93(a) says no structure shall be placed on any State road or highway "and no obstruction placed thereon, without a written permit" from the Department of Transportation; doing so is a Class 1 misdemeanor. City streets not maintained by NCDOT are outside that statute, which is why Fayetteville runs its own permit. In unincorporated Cumberland County, the roads outside city limits are state roads. We found no NCDOT guidance written specifically for roll-off dumpsters — reading a dumpster as an "obstruction" is our reading of the statute, not an NCDOT statement — so on a state road, the driveway is the answer.

Hope Mills, Spring Lake and Raeford

Hope Mills Code Sec. 86-4(a) bars placing "any boxes" or "any other obstruction of any kind" in the town's streets, sidewalks or alleys. Sec. 86-4(b) lets anyone erecting a building, "with permission," place building material for immediate use on the streets without interfering with traffic, but the code does not say who grants that permission or what it costs, and Sec. 86-5 requires a passageway to keep sidewalks open during construction. Sec. 78-3 says construction and demolition debris "shall be removed by the property owner within ten days from the completion of such work." For anything on a Town street, call Hope Mills Public Works (910-429-3387) first.

Spring Lake Code Sec. 34-49 makes it unlawful to pile rubbish, lumber, dirt "or other obstruction of any kind" on a sidewalk, and the Town's permits page lists building, demolition and zoning permits but no right-of-way permit. Sec. 40-81 gives the owner ten days after the work is done to remove building debris. Raeford Code Sec. 16-1 says "It shall be unlawful to place any structure or other obstruction whatsoever in or over any of the streets or sidewalks," punishable as a misdemeanor, and we found no permit process — so in Raeford the container goes on private property. Sec. 9-4 adds that the City will not collect building materials or refuse created by a landscaper or contractor.

Unincorporated Cumberland County and the small towns

Unincorporated Cumberland County — Vander, and the areas between the towns — has no county dumpster permit that we could find in the County Code chapters on motor vehicles, offenses, buildings or solid waste. The roads are state roads, so G.S. 136-93 applies to anything placed on them. Stedman's posted code of ordinance has no solid waste, dumpster, street-obstruction or hauler section. Eastover has no posted code and sends planning and inspections to Cumberland County (910-678-7600). Wade has no posted code; Falcon's Community Standards Ordinance covers junk, litter and overgrown lots but not dumpsters; Godwin and Linden have no website or online code. In each, keep the box on the property and County rules apply.

Over the county line: no street permit or dumpster rule was found for Parkton (Robeson County), Cameron (Moore County) or Autryville (Sampson County), and none for Bunnlevel, which is unincorporated Harnett County. Most of their roads are state roads too, so the driveway is the plan.

Who may haul — and we hold ours

Fayetteville City Code Sec. 22-13(B) says "It shall be unlawful to commercially collect, handle, haul or transport on any of the streets, public ways/ alleys, or other places of the City any waste without obtaining the necessary approvals, permits and licenses to do work in the City." The same section wants waste carried in covered containers and loads secured so nothing blows or spills. Cumberland County Code Sec. 11-41.2(a) says collectors "shall not be allowed to enter and use the county landfill unless they have obtained and display a solid waste collector's permit from the county health department," registered with the Solid Waste department. Sec. 11-33 lets owners hire any permitted collector — we found no exclusive franchise for roll-offs anywhere we serve.

The neighboring counties have their own rules. Robeson County haulers "must be approved and licensed by the County Solid Waste Director," renewed yearly — that covers Parkton. Moore County Code Sec. 8-160 requires a written health department permit to collect or transport solid waste for profit — that covers Cameron. Harnett County charges a Waste Hauler Permit of $135 per vehicle per year — that covers Bunnlevel. Hoke County licenses residential haulers annually. Quick Roll Dumpsters holds the permits and licences these places require — we hold ours.

What this means when you book

Tell us the address and where you want the box. A Fayetteville driveway is the simplest case. A city street spot takes the City encroachment permit, the pedestrian path or signs, and lights at night, so give yourself a few extra days of lead time. A state road takes NCDOT, and in Raeford the street is off the table. If your neighborhood has an HOA, check its rules on how long a container can sit in the driveway. Call (910) 672-8396, 24 hours a day, 7 days a week.

Frequently asked questions

Do I need a permit for a dumpster on my driveway in Fayetteville?

We found no City of Fayetteville permit for a roll-off on a private driveway. Your HOA may still have rules, so check them. On a city street or sidewalk, you need a City Temporary Right-of-Way Encroachment permit.

How do I get a Fayetteville right-of-way permit for a dumpster?

Fill out the City's Temporary Encroachment Permit through the Public Services Engineering Division, on paper or the City's IDT portal. It is valid for 30 days. The FY2025–26 fee schedule listed $75 per 30 days for construction dumpsters, so check the current fee when you apply.

Can a dumpster go on the road outside the city limits?

Roads outside city limits are usually state roads, and G.S. 136-93 requires a written NCDOT permit for any obstruction placed on them. Keep the container on the driveway or private property.

Does the company supplying the dumpster need a permit?

Yes. Fayetteville requires the necessary approvals, permits and licenses to haul waste in the City, Cumberland County requires a health department collector's permit to use its landfill, and Robeson, Moore and Harnett counties license or permit haulers. We hold ours.
